NOTICE OF DETERMINATION

North Vancouver, B.C. – November 10, 2022 – Transport Canada has determined that the proposed North Shore Railyard Expansion is not likely to cause significant adverse environmental effects.

This determination was based on a consideration of the following factors:

  • impacts on rights of Indigenous peoples;
  • Indigenous knowledge;
  • community knowledge;
  • comments received from the public; and
  • technically and economically feasible mitigation measures.

Mitigation measures taken into account for this determination are:

  • Activities will be carried out in accordance with the construction environmental management plan 
  • Works will be carried out in accordance with the management recommendations provided in the Archaeological Impact Assessment 
  • An updated soil management plan will be submitted to the Vancouver Fraser Port Authority's satisfaction, detailing how soils will be tested, appropriately handled to prevent migration/run-off, and disposed of at a licensed facility if unsuitable for reuse 
  • A qualified environmental professional will monitor the Project in order to ensure that the works are carried out in compliance with the Permit issued by the Vancouver Fraser Port Authority 

Transport Canada is satisfied that that the carrying out of the project is not likely to cause significant adverse environmental effects.

Therefore, Transport Canada may carry out the project, exercise any power, perform any duty or function, or provide financial assistance to enable the project to be carried out in whole or in part.
